How is the probate process handled in Florida?

Most notably, probate is required when someone passes away without a will or a trust. It serves as a way to distribute the estate and take care of all the current tax obligations. It should be noted, however, that not all assets are required to go through probate. This can simplify the process and reduce the effort that is expended.

Assets that may be able to avoid probate include:

  • Property held in joint tenancy by two or more people
  • Assets that have a designated beneficiary
  • Assets held in a living trust

If probate is necessary, the appointed executor or other individual steps forward to oversee the proceedings. The court supervises the administration of the estate, such as paying back debts, inventorying the assets, and distributing property to the inheritors. Because there is so much at stake with your loved one's property, it is imperative that you retain a lawyer who will protect your best interests.
